General terms and conditions of sale and use

These General Terms and Conditions of Sale (GTCS) govern the offer and sale of vibrances, unique works of art, on the website vibrance.systems. As Néo Valen, Delesteur, I offer these vibrances, encoded emotional information units, created through a poetic system and stored in the Cell-IOn machine. Each vibrance is an original artwork, non-exchangeable and non-refundable, reflecting the essence of my artistic craft.

The vibrances sold on vibrance.systems are offered directly by Néo Valen, registered with the RCS of Paris under SIRET number [to be specified]. This e-commerce activity is exclusively aimed at end users, defined as individuals acting for non-professional purposes. If you are not an end user, please refrain from making transactions on vibrance.systems.

Each vibrance is a unique work of art, accompanied by a digital certificate of authenticity. Visual representations or descriptions are not contractual, as they capture the poetic spirit of the work rather than its exact form. Néo Valen disclaims liability for improper use of vibrances. We encourage buyers to maintain critical judgment and understand the artistic nature of these creations. Due to their uniqueness, no returns or exchanges are possible.

Néo Valen reserves the right to refuse orders from individuals not meeting the end-user definition or non-compliant with the commercial policy outlined herein. The GTCS may be updated, particularly due to regulatory changes. New terms will apply upon their publication on vibrance.systems.

Shipping and Customs

VAT on vibrances is 5.5% in France. Duties and taxes may apply outside the Eurozone.

Vibrances, being digital artworks, do not require physical shipping unless integrated into emochains, capsules, or phygital objects (emochain.art, capsule.arseneca.com, phygital.arseneca.com). In such cases, products are delivered to the address provided during the order, with a target delivery time of 10 working days. You will be notified by email of any delays or issues. Shipments in France are handled by La Poste (Colissimo or Lettre Max).

Shipping costs, calculated automatically at checkout, are included in the total. A tracking number is sent by email upon dispatch. Customs duties and taxes outside the Eurozone are the buyer’s responsibility. In case of loss or damage during transport, notify the carrier immediately. Néo Valen disclaims liability for transport-related incidents.

PRICES

Vibrance prices

Vibrance prices are listed in euros, inclusive of all taxes (VAT at 5.5% in France), excluding processing and shipping fees, calculated separately. For orders outside the European Union or DOM-TOM, prices are displayed excluding taxes on the invoice, and customs duties, local taxes, or import fees may apply, at the buyer’s expense. Please check local regulations. All orders must be paid in euros. Néo Valen reserves the right to modify prices, but vibrances are invoiced at the rates applicable at the time of order, subject to availability.

AVAILABILITY

Vibrance availability

Vibrances are offered subject to availability, each being a unique artwork. During checkout, verify the accuracy of your details (name, email, address) and vibrance specifics (type, quantity). An unavailable vibrance displays “out of stock” and cannot be ordered. If a vibrance becomes available again, you may request email notification by contacting [contact@vibrance.systems].

RETURNS AND RIGHT OF WITHDRAWAL

Withdrawal policy

Néo Valen, Delesteur, offers vibrances, unique works of art accompanied by a digital certificate of authenticity. Due to their specific and personalized nature, vibrances are neither returnable nor exchangeable.

Under Ordinance No. 2016-301 of March 14, 2016 – art., the right of withdrawal does not apply to vibrances, as they are unique digital products or integrated into custom-made items, non-reintegratable into the distribution chain for authenticity and security reasons.

All texts, descriptions, visuals, and certificates associated with vibrances on vibrance.systems are protected by copyright and intellectual property laws worldwide. Under the Intellectual Property Code, only private use is permitted, subject to stricter provisions. Any unauthorized reproduction, modification, or use constitutes infringement, subject to penalties. Vibrances, as unique artworks, remain the intellectual property of Néo Valen, Delesteur. All rights reserved.

APPLICABLE LAW – DISPUTES

Law and jurisdiction

This contract is drafted in French and governed by French law. In case of legal disputes, only French courts shall have jurisdiction.

Data collected during your order is confidential and used solely to process purchases, personalize your experience, and share cultural updates related to vibrance.systems, including newsletters you may subscribe to. Ordering on vibrance.systems

For your first order, create an online account with your personal details and keep them updated. The order is finalized when Néo Valen receives the order form, after verifying the accuracy of the provided data. Before purchasing, carefully read these General Terms and Conditions of Sale. By submitting the order form, you unconditionally accept and agree to comply with these GTCS. If you disagree with any terms, please do not submit an order on vibrance.systems.

ORDER VALIDATION

Order confirmation

Data recorded by Néo Valen during order validation serves as proof of all transactions. Payment system data confirms financial transactions.

PAYMENT

Online payment

Orders shipped to France and the EU are quoted in euros, inclusive of all taxes (VAT at 5.5% in France). For purchases under 400 euros, Néo Valen accepts online payments via PayPal, Visa, MasterCard, or American Express. For purchases of 400 euros or more, only PayPal (www.paypal.com) is accepted. Additional information may be required to secure your payment.
